Terms of Use

1. Acceptance

By accessing or using BitShack (bitshack.co.za) or any app hosted on the BitShack platform, you agree to be bound by these Terms of Use. If you do not agree, please do not use the platform.

2. The platform

BitShack is a free platform that hosts Progressive Web Apps built for South African businesses. We provide access to apps including FitVoice, Guard, PropSpec, and GroupOrder Bot. Each app is operated as a separate service accessible via its own subdomain.

3. Free service

BitShack and the apps it hosts are provided free of charge. We reserve the right to introduce paid features in future apps. Any such changes will be clearly communicated in advance and will not retroactively affect free access to existing functionality.

4. Your use of the platform

You agree to use BitShack and its apps only for lawful purposes and in accordance with these terms. You must not:

— attempt to gain unauthorised access to any part of the platform or its infrastructure;
— use the platform to transmit harmful, unlawful, or fraudulent content;
— reverse engineer, decompile, or attempt to extract source code from any app;
— use automated tools to scrape or abuse the platform.

5. Individual app terms

Each app on BitShack (FitVoice, Guard, PropSpec, GroupOrder Bot) may have its own additional terms, conditions, or acceptable use policies. When using a specific app, those terms apply in addition to these general terms. Where there is a conflict, the app-specific terms take precedence.

6. Intellectual property

All content on BitShack — including app code, design, copy, and branding — is the intellectual property of BitShack and its developers. You may not reproduce, distribute, or create derivative works without written permission, except as expressly permitted by these terms.

Data you create or input into BitShack apps (invoices, orders, security logs, etc.) remains yours. We do not claim ownership of your data.

7. Disclaimer of warranties

BitShack and its apps are provided "as is" without warranty of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or suitable for your particular purpose. Use the platform at your own risk.

8. Limitation of liability

To the maximum extent permitted by South African law, BitShack and its developers shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the platform or any app — including but not limited to loss of data, loss of profit, or business interruption.

Our total liability to you for any claim arising from use of the platform shall not exceed the amount you paid to us in the 12 months preceding the claim. Since the platform is free, this amount is zero.

9. Third-party services

Some apps integrate with third-party services (such as WhatsApp). Your use of those services is governed by the relevant third party's terms. BitShack is not responsible for the availability, accuracy, or conduct of third-party services.

10. Termination

We reserve the right to suspend or terminate access to BitShack or any app at any time, with or without notice, if we believe you have violated these terms or if we discontinue the service.

11. Governing law

These terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the South African courts.

12. Changes to these terms

We may update these terms from time to time. The effective date at the top of this page reflects the most recent revision. Continued use of the platform after an update constitutes your acceptance of the revised terms.
